These Terms of Service ("Terms") govern your access to and use of the Fyndly mobile application, website, and related services (collectively, the "Services").

By accessing or using Fyndly, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use Fyndly.

If you are under 18, you represent that you have permission from a parent or legal guardian.

By using the Services, you represent that you meet these requirements.

2. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account
• All activity under your account
• Providing accurate information

We may suspend or terminate accounts at our sole discretion.

3. User Content

"User Content" includes videos, captions, comments, profile information, and any material you upload.

You retain ownership of your content.

However, by uploading content, you grant Fyndly a:

• Worldwide
• Non-exclusive
• Royalty-free
• Transferable
• Sublicensable

license to:

• Host
• Display
• Reproduce
• Modify for formatting
• Distribute
• Promote
• Advertise
• Create derivative works for marketing purposes

This license continues even if you delete your account (for content already used in marketing materials).

You represent and warrant that:

• You own or have rights to the content
• Your content does not infringe intellectual property rights
• Your content does not violate laws or third-party rights

4. Prohibited Content & Conduct

You may not upload or engage in:

• Illegal content
• Harassment or threats
• Hate speech
• Pornographic or sexually explicit content
• Impersonation
• Misleading or fraudulent information
• Spam or commercial solicitation
• Content violating intellectual property rights

We reserve the right to remove content at our sole discretion.

5. Business Listings

Business listings may be sourced from third-party providers or public data.

Fyndly:

• Does not guarantee accuracy
• Does not verify all listings
• Is not responsible for business conduct

Interactions between users and businesses are solely between those parties.

6. Advertising

Fyndly displays advertisements.

We are not responsible for:

• Products or services advertised
• Claims made by advertisers
• Transactions between users and advertisers

7. Analytics & Business Accounts

Businesses claiming listings may receive:

• Engagement metrics
• Audience insights
• Performance data

We do not guarantee specific performance results.

Analytics may be aggregated and anonymized.

8. Intellectual Property

All Fyndly branding, logos, interface design, and software are owned by Fyndly, Inc.

You may not:

• Copy
• Reverse engineer
• Distribute
• Modify
• Use branding without written permission

9. Copyright & DMCA

If you believe content infringes your copyright, contact: Admin@Fyndly.com

Include:

• Identification of copyrighted work
• Identification of infringing material
• Contact information
• Statement of good faith belief
• Statement under penalty of perjury

We may remove allegedly infringing material and terminate repeat infringers.

10. Termination

We may suspend or terminate access:

• For violation of these Terms
• For suspected fraud or abuse
• At our sole discretion

You may delete your account at any time.

11. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE."

Fyndly makes no warranties regarding:

• Accuracy of content
• Reliability of listings
• Availability of the app
• Uninterrupted access

12. Limitation of Liability

To the fullest extent permitted by law:

Fyndly shall not be liable for:

• Indirect damages
• Lost profits
• Lost data
• Business interruption
• Personal injury resulting from interactions with businesses

Total liability shall not exceed $100 USD or the amount you paid to Fyndly (if any), whichever is greater.

13. Indemnification

You agree to indemnify and hold harmless Fyndly from any claims arising from:

• Your content
• Your violation of these Terms
• Your violation of third-party rights

14. Arbitration & Dispute Resolution

Any dispute shall be resolved through binding arbitration in the State of California.

You waive the right to:

• Jury trial
• Class action participation

15. Changes to Terms

We may update these Terms at any time.

Continued use constitutes acceptance of updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of California.
